Mental health care must respect own will, preferences, and informed consent – New recommendation by Council of Europe

The Council of Europe adopted new Recommendation on autonomy in mental health care.

The Recommendation says that people’s own will, preferences, and informed consent must be at the centre of mental health care, rather than decisions being made for them.

Inclusion Europe is one of ten organisations who advocated for this Recommendation.

Stop Oviedo – campaing continues

Approving of the reccommendation is a good development, but discussions for the adoption of the Draft Protocol of the Oviedo Convention continue.

This Protocol would allow forced treatment in mental health care settings.

Together with our partner organisations we call on the Council of Europe countries to fully implement this recommendation, including through:

  • Legislative reforms, policy initiatives and investments in community-based services;
  • Meaningful involvement of persons with lived experience in the design, delivery, and evaluation of mental health policies.

This is essential to ensure that autonomy and human rights are not only recognised in principle but realised in practice.
