We urge EU institutions to amend the Regulation on Protection of Adults in Cross-Border Situations to prevent human rights violations against persons with disabilities and older adults.
The European Commission introduced a proposal for a Regulation governing the cross-border protection of adults, affecting directly persons with disabilities and older adults.
Persons with disabilities and older adults are considered unable to protect their interests in cross-border situations, such as having money abroad, seeking medical care, or relocating within the EU.
Our concerns: Several binding provisions are not in line with the UN CRPD.
- The recognition of deprivation of legal capacity across the Union.
- Unclear recognition of supported decision-making mechanisms.
- Facilitated cross-border placement in residential and psychiatric institutions.
European Disability Forum, European Network on Independent Living, Inclusion Europe, Mental Health Europe and AGE Platform Europe and also endorsed by the European Council of Autistic People propose amendments to the regulation.
